1. Corporate Identity and Merchant of Record
Smart Launch Suite is a software product developed and operated by Avaris Consulting Co., Ltd., Bangkok, Thailand ("Avaris," "we," "our").
Avaris Consulting Co., Ltd. is the Merchant of Record for all transactions processed through our secure payment partner, Stripe.
All invoices, receipts, and statements will show Avaris Consulting Co., Ltd. as the seller.
Payments are processed by Stripe using PCI-DSS Level 1 encryption.
Applicable taxes (VAT, GST, sales tax) are calculated via Stripe Tax for international sales and directly by Avaris for domestic Thai transactions.
2. Acceptance of Terms
By accessing, purchasing, downloading, or using Smart Launch Suite products, services, or software (collectively, the "Services"), you agree to these Terms of Use ("Terms"). If you do not agree, you may not use the Services.
3. Definitions
- "Company," "We," "Us," "Our" = Avaris Consulting Co., Ltd. and its affiliates.
- "Customer," "You," "Your" = the individual or entity purchasing or using the Services.
- "Services" = Smart Launch Suite software, smart contracts, documentation, support, and related materials.
- "Smart Contracts" = blockchain-based code delivered as part of the Services.
- "Documentation" = all written materials, guides, and deployment instructions.
4. Service Description
Smart Launch Suite provides:
- Production-ready smart-contract templates for DeFi and Web3 applications.
- Documentation and deployment guides.
- Tiered technical support and consulting.
- Software licenses for deployment, testing, and modification.
Service Tiers

5. License Grant and Restrictions
5.1 Grant
Avaris grants you a limited, non-exclusive, non-transferable license to use, deploy, and modify Smart Launch Suite smart contracts for your own blockchain projects.
5.2 Restrictions
You may not:
- Resell, redistribute, or sublicense the software.
- Use it to compete directly with Smart Launch Suite.
- Remove or alter proprietary notices.
- Use the Services for unlawful or unauthorized purposes.
- Reverse-engineer or decompile except where permitted by law.
Licenses take effect upon successful payment and remain valid as long as you comply with these Terms. Non-payment or chargeback automatically terminates the license.
6. Disclaimer of Warranties
The Services are provided "as is" and "as available" without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
We do not guarantee that:
- The Services will meet your specific requirements.
- Smart Contracts are error-free or immune to vulnerabilities.
- Access will be continuous or secure.
- Third-party integrations will function as intended.
7. Limitation of Liability
To the fullest extent permitted by law, Avaris Consulting Co., Ltd. is not liable for:
- Loss of profits, tokens, digital assets, or data.
- Trading or investment losses.
- Smart-contract bugs, network failures, or gas-fee losses.
- Third-party service disruptions or integration failures.
- Any indirect, incidental, or consequential damages.
Total Liability Cap: Our liability shall not exceed the amount you paid for the specific Service giving rise to the claim.
8. Blockchain and Cryptocurrency Risks
You acknowledge the inherent risks of blockchain technology, including volatility, regulatory changes, smart-contract bugs, network congestion, and liquidity risks.
Smart Launch Suite provides no investment, legal, or financial advice.
You are solely responsible for compliance, due diligence, and risk management.
9. Pricing and Payment
All prices are quoted in USD (or equivalent). Taxes are shown at checkout.
Payment Processing & Security
- Payments are processed via Stripe.
- Stripe uses SSL / HTTPS encryption and PCI-DSS Level 1 compliance.
- Accepted methods: major credit cards and other options shown at checkout.
- Your payment statement shows: AVARIS CONSULT SMARTLAUNCH.
- Avaris Consulting Co., Ltd. issues all receipts and manages refunds or chargebacks.
10. Refund and Guarantee Policy
All sales are final except as outlined in our Refund & Guarantee Policy.
Avaris is committed to providing full assistance until the purchased deployment functions as intended.
11. Force Majeure
We are not responsible for delays or failures caused by circumstances beyond our control, including natural disasters, cyberattacks, acts of war, labor disputes, or blockchain network outages.
12. Severability
If any clause of these Terms is found invalid or unenforceable, the remainder will remain valid and enforceable.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles.
Disputes shall be resolved exclusively in Thai courts.
EU / UK consumers retain any non-waivable statutory rights under local law.
